Terms of Use

1. Acceptance

These Terms of Use (“Terms”) are an agreement between you and Myrmidons LLC, doing business as Rune 13 (“Rune 13”, “we”, “us”), and govern your use of the website at rune13.com (the “Site”). By using the Site, or by submitting a form on it, you agree to these Terms and to our Privacy Policy, which is part of them. These Terms are an electronic record, and you agree to deal with us electronically through the Site. If you do not agree, please do not use the Site.

2. What the Site is for

The Site describes Rune 13’s recruiting services for commercial construction and data center / critical infrastructure employers and candidates, and lets you contact us. It is intended for people 18 or older acting for themselves or for a business.

3. No employment, agency or guarantee

Rune 13 is a recruiting firm. We are not the employer of the candidates we present, and we are not a job board. Sending us a resume, a message or an inquiry does not make you an employee of, or an applicant for employment with, Rune 13; does not make Rune 13 your agent or fiduciary; does not create a contract with Rune 13; and does not obligate Rune 13 to present you to any employer or to fill any role. Rune 13 does not guarantee interviews, offers, employment, compensation, or that any candidate will accept an offer or remain in a role. Employers make their own hiring decisions; candidates make their own career decisions. Rune 13 refers candidates without regard to race, color, religion, sex, pregnancy, national origin, age, disability, genetic information, marital status or any other characteristic protected by law.

Recruiting services for employers are provided only under a separate written agreement, and our fees are paid by the employers that engage us. Rune 13 never charges candidates a fee of any kind, and no candidate will be asked to pay for a referral, introduction or placement. Nothing on the Site is an offer to provide services on any particular terms, and no fee, timeline or guarantee is created by anything on the Site.

4. Your submissions

When you send us information through the Site, you confirm that it is accurate, that it is yours or that you are authorized to share it, and that it does not include anyone else’s personal information without their permission. You agree not to upload files containing malicious code and not to submit information that is unlawful, defamatory or infringing. We may decline to act on any submission. Our use of the personal information you send is described in the Privacy Policy.

5. Acceptable use

You agree not to: use the Site for any unlawful purpose; scrape, harvest or copy Site content or contact details in bulk; interfere with the Site’s operation or security; submit spam or automated inquiries; or misrepresent who you are or who you work for.

6. Intellectual property

The Site and its content — text, design, graphics, the Rune 13 name and logo — are owned by Myrmidons LLC or used under license and are protected by copyright and trademark law. Photographs are licensed stock images (Unsplash License and Pexels License) and remain the property of their photographers; the people and sites shown are illustrative and are not Rune 13 staff, clients or candidates, and no endorsement is implied. Fonts are used under the SIL Open Font License. You may view the Site and print pages for your own use in dealing with Rune 13. You may not copy, republish, modify or use the content or marks for any other purpose without our written permission.

7. Links to other sites

The Site links to third-party sites, such as LinkedIn. We do not control those sites and are not responsible for their content, availability or practices.

8. Disclaimers

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Rune 13 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the Site will be uninterrupted, error-free or secure. Information on the Site is general and may change without notice.

9. Limitation of liability

To the fullest extent permitted by law, Rune 13 and its owners, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, business or opportunity, arising from your use of or inability to use the Site, even if advised of the possibility. Rune 13’s total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US $100); the Site is free to use, and this limit reflects that. Nothing in these Terms limits liability for fraud or willful misconduct, or any liability that cannot be limited under applicable law. If the law where you live does not allow a limitation above, it applies to you only to the extent that law permits.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Rune 13 and its owners, employees and agents from third-party claims, losses and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or information you submit that you had no right to share.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. You waive any objection to venue in those courts.

12. Changes

We may update these Terms by posting a new version on this page with a new Effective date. If a change is material, we will also post a notice on the Site for at least 30 days. The version in force when you use the Site or submit a form is the one that applies to that use or submission. Your continued use of the Site after a new Effective date means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and Rune 13 about your use of the Site; they do not replace any written services agreement between Rune 13 and an employer.
